Finmo AI Tool Beta Program Terms & Conditions

Please read these Terms & Conditions (“Terms”) of the beta program for the Finmo AI Tool (“Beta Program”) carefully before accessing the Finmo AI Tool. By clicking “Accept” or using the Finmo AI Tool, you agree to these Terms on behalf of your brokerage or organization (“Participant”).

 

These Terms are in addition to the Finmo Terms of Use or other agreement between Participant and Lendesk Technologies ULC (“Lendesk”). If there is a conflict, these Terms govern your use of the Finmo AI Tool.

 

1. Eligibility

Access to the Finmo AI Tool is limited to existing brokerages using Finmo and by invitation only. Participation is at Finmo’s sole discretion and may be revoked at any time.

 

2. Beta Use Only

The Finmo AI Tool is a beta product, not final, and may be changed or removed at any time. The Beta Program is for evaluation purposes only.

 

3. Data Collection and Use

 

By using the Finmo AI Tool, Participant consents to Lendesk collecting, storing, and processing all data input into, or generated by, the Finmo AI Tool (“Beta Data”), including any text, documents, metadata, or interaction logs. Participant acknowledges and agrees that Lendesk may use Beta Data to operate, analyze, and improve the Finmo AI Tool and other Finmo products and services, including for training and fine-tuning underlying machine learning models.

 

Participant further agrees that Lendesk may derive and use insights, analytics, and model outputs from the Beta Data for commercial and product development purposes, provided that such use does not identify Participant or its clients. Participant confirms it has obtained all necessary rights, consents, and authorizations to provide Beta Data to Lendesk  and to permit the uses described in this section.

 

4. Confidentiality

Participant agrees to keep the Finmo AI Tool and all related information and feedback confidential, and not to disclose or share it outside of Participant’s organization.

 

5. Feedback and IP

Lendesk owns all rights to the Finmo AI Tool. Any feedback you submit may be used by Lendesk for any purpose without obligation or compensation. You agree to meet weekly, or at such other time mutually agreed to by the parties, with Lendesk to provide feedback on the Finmo AI Tool and to demonstrate Lendesk how you are using the Finmo AI Tool. 

 

6. Disclaimer

The Finmo AI Tool is provided “as is” without warranties of any kind. Use of the Finmo AI Tool is at Participant’s own risk. Lendesk disclaims all liability arising from use of the Finmo AI Tool, including any decisions based on its outputs. The Finmo AI Tool may contain bugs, errors, or other issues. The Finmo AI Tool may be modified, suspended, or discontinued at any time without notice. Lendesk makes no guarantees regarding uptime, reliability, or performance during the Beta Program period. Support for the Beta Program may be limited. Lendesk reserves the right, at our sole discretion, to amend these Terms at any time.

 

7. Termination

Lendesk may suspend or terminate access to the Finmo AI Tool at any time, for any reason, with or without notice.

 

8. Governing Law

The Terms and any access to or use of the Beta Program shall be governed by, and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada therein, without giving effect to any choice or conflict of law provision or rule that would cause the application of the laws of any jurisdiction other than those of the Province of British Columbia.
